Man Removes His ‘Anonymous’ Mask After Steubenville Rape Trial

By Jim Heath

COLUMBUS, Ohio – The man behind the Guy Fawkes mask, known online as KyAnonymous, revealed himself to supporters in front of the U.S. Attorney’s Office in Columbus on Monday.

Deric Lostutter admits he’s part of hacker-activist collective Anonymous, but says he’s done nothing illegal and was compelled to come forward after the FBI raided his Kentucky home in April.

“It was kind of intense,” said Lostutter.  “They came out with M16 assault rifles. CIS, two state troopers, the local sheriff — all for my little computer.”

About a dozen supporters delivered boxes of petitions to the U.S. Attorney’s Office Monday.

Many chanted, “We demand justice for Deric” and held signs “Deric is a hero.”

They’ve also raised $50,000 for his legal defense fund.

Hiding behind the mask, Lostutter, a self-employed IT security specialist, went by the online name KyAnonymous during the Steubenville rape trial.

Hacker activists helped propel national coverage of the rape case.

Lostutter admits posting a web video showing a student joking about the attack, but says he didn’t hack any computers.

“The information I had was there possibly (was) a cover up going on,” said Lostutter.

Two Steubenville football players were convicted of rape.

Ma’Lik Richmond was sentenced to at least a year in the state juvenile detention system.

Trent Mays was sentenced to at least two years in juvenile detention.  He was also convicted of photographing the underage girl naked.

Melanie Jones of Demand Progress says Lostutter could face 10-25 years in prison if found guilty of computer crimes and that’s unfair.

“Because someone stepped up and said there is corruption in this case and rape culture is wrong, he was going to be made an example of,” said Jones. “Having a man step forward and say ‘rape is wrong’ and be punished for it is the worst lesson you could give any generation, certainly mine.”

A spokesman for the U.S. Attorney’s Office told 10TV on Monday that the protestors were respectful.

“But there is an investigation under way into a possible crime of computer hacking, so we really can’t say anything,” the spokesman said.

Three teen witnesses were granted immunity from prosecution by a judge to allow them to testify against the two players.

State prosecutors are still investigating whether coaches or school administrators knew of the rape allegation but failed to report it.

Lostutter says he did the right thing.

“Behind the mask, I’m a whole completely different dude than you expect some computer guy to be, so I can stare adversity in the face and come right at it,” said Lostutter.

The government could indict Lostutter on alleged felony violations of the Computer Fraud and Abuse Act.

Lostutter’s attorney on Monday asked the government to return his computer and dismiss the investigation.

Drop The Charges Against Deric Lostutter/ Ky Anonymous Rally in Columbus, Ohio Has Low Turnout

10 people showed up to hear Deric Lostutter/ Aka KY Anonymous speak outside of the Ohio Attorney General’s Office. It was very apparent that no one from #oprollredroll or those involved in Steubenville were in attendance. In fact, unless any of the 10 supporters who showed were anons and just were  unmasked for the day, it’s fair to say that no members of anonymous were present to support Ky as he spoke to his supporters and wanted to demand his charges be dropped. KY has not been charged with a crime in the 2 months since the FBI raid on his home, but his attorney’s are confident “He will be charged any day now.”

Ky is still facing heavy public scrutiny over raising over $53,500 for his legal defense for when  charges are filed against him. Ky wearing a white Knightsec tshirt available from his website, and wearing a guy fawkes mask on top of his head accompanied supporters inside the building to deliver a 200,000 signature petition to drop the possible pending charges against the 26-year-old rapper. Over the weekend another anon, @anonforecast claimed to have been raided by the FBI in connection with #oprollredroll In which this anon who had nothing to do with Steubenville was questioned about certain screen names from twitter and had his phone seized.

Ky Read a prepared statement from his phone, and the petition to the AG’s office was delivered. The rally lasted around 38 minutes which is a drastic switch from the #occupysteubenville rallies which would last 3-4 hours.

Further internet controversy occurred over the weekend when Ky Anonymous compared himself to recently deceased journalist Michael Hastings.

Where have all of Ky’s supporters gone?

A Pastebin To Answer Questions About KYAnonymous aka @shadowrapz

Pastebin— http://pastebin.com/0VTEQxA7

I’m not sure who wrote this pastebin, but it answers some questions maybe?

Some answers to questions that have been asked and about Deric Lostutter (AKA: KYAnonymous). I hope this helps to ease some concerns. If you have more questions, please feel free to ask and I will do my best to get the answers for you. You can also contact his attorney, Jason Flores-Williams of the Whistleblowers Defense League, by calling (505) 467-8288.

Please keep in mind that I do not know Mr. Lostutter in person and I am not affiliated legally in any way. I am just trying to help.

About the Warrant:
On April 15, 2013 Deric’s house in Winchester, KY was raided and he was served a search and seizure warrant granted by US Magistrate Judge Robert E. Wier. Case No. 5:13-MJ-5116-REW
You can see photos of this warrant at http://www.projectknightsec.com/

About Mr. Flores-Williams Working Pro-Bono:
There seems to be a common misconception that “pro-bono” always means free of charge. Pro-bono can also mean reduced cost.

“Pro bono publico (English: for the public good; usually shortened to pro bono) is a Latin phrase for professional work undertaken voluntarily and without payment or at a reduced fee as a public service. It is common in the legal profession and is increasingly seen in architecture, marketing, medicine, technology, and strategy consulting firms. Pro bono service, unlike traditional volunteerism, uses the specific skills of professionals to provide services to those who are unable to afford them.”
– en.wikipedia.org/wiki/Pro_bono

While Mr. Flores-Williams is not charging a fee directly to Deric, he is accepting donations for his work. There will be a lot of charges incurred with all that Mr. Flores-Williams must do. Deric is not in jail, but he has been sent a target letter which shows that Deric’s case is in the pre-indictment phase.

“A target letter is a letter that a federal prosecutor at a United States Attorney’s office sends to inform someone that he or she is the target of a federal investigation. Most often, the letter informs the recipient of the nature of the charges being investigated (e.g. insider trading, wire fraud, etc.). Target letters are used during the target or pre-indictment phase of a white-collar crime investigation. As might be expected, a target letter advises the recipient of his or her rights, in particular the right to counsel and the right not to testify. If you receive a target letter, you are most likely going to be indicted.”

About Defense Fund Donations:
Mr. Flores-Williams states, “Your contribution–we so deeply thank you–will be utilized to cover general legal defense costs and expenses, which will be in the hundreds of thousands of dollars. For example: basic travel costs for attorneys to hearings, basic travel costs for witnesses to hearings, multitudinous subpoenas (service of process expenses), government witness interviews and legal document transcription costs for possible impeachment at trial, expert witnesses ranging from 6 to 10k per (not including their travel and report expenses), independent computer forensics, investigation of persons in Ohio, pretrial discovery, voir dire research: this is all prior to commencement of actual trial of which basic costs–travel, stay; witness travel and lodging, exhibits and document prep, are extremely high.”

“Furthermore, there may be a need for security for the defense team during any extended stays in the Steubenville area.”

“The WBDL does not charge a fee or make a profit–we are a volunteer legal organization defending those who defend democracy. If you have any questions concerning your donation, we absolutely encourage you to contact The Law Office of Jason Flores-Williams, lead counsel for Deric Lostutter and co-founder of The WBDL.

“If the government were to offer an amenable plea agreement that does not condemn Deric to prison and so that these resources were not fully used, then all donors would be contacted forthwith with the good news and potential return of their generous donation.”

About Deric’s Control Over the Money Raised for the Defense Fund:
Mr. Flores-Williams states, “Donations to this legal defense fund are not tax deductible and will become the sole property of, and be used at the sole discretion of, The Law Office of Jason Flores-Williams, Esq. Feel free to contact us if you have any questions regarding this at: 505-467-8288.”

The Furor Over The Deric Lostutter Defense Fund

734805_516761971678166_886485252_n (2)

I said this last night on Twitter—>I support #OPFreeKY…I feel like he’s being prosecuted because he stood up for a victim. I think he was trying to do the right thing. Hacking? I highly doubt he actually hacked anything because I was told months ago he’s not a hacker.

I cannot and do not support his lawyer raising funds before any charges are filed. There’s just something shady about that to me. If he had been arrested I would’ve gladly donated to him, but he hasn’t been charged with anything.

I will continue to spread the word of rallies to support him. I cannot attend any rallies, but I will promote them so people who may not have Facebook can decide if they would like to attend.

If you would like to donate, read the fine print. I’ve been told that there is a refund policy.
