The very recent and emotional case of Jahi McMath has gotten international news. A 13-year-old 8th grader goes into Children’s Hospital in Oakland, California to have surgery on her tonsils and surrounding tissue to help with her sleep apnea. The surgery goes well and she wakes up in the ICU. (I’ll get to that in a few) Suddenly she starts to bleed out of her nose and mouth and passes out before the nurses call the Dr. (According to the family. The hospital can’t comment on that stuff because of Federal HIPAA laws) They do a CT scan and determine she has brain swelling and ultimately her brain is no longer functioning.

Luke “Sasha” Fleischman is a Senior at Maybeck High School in Berkeley. He fell asleep on an AC Transit bus riding through Oakland on Monday night when a 16 year-old Oakland High boy set him on fire Oakland PD says because he was wearing a skirt.
“My son considers himself agender,” Debbie Fleischman said. “He likes to wear a skirt. It’s her statement. That’s how he feels comfortable dressing.”
Police say the 16 year-old Oakland boy boarded the bus near his school and saw the 18-year-old victim sleeping in the back of the bus wearing a skirt. He then set Sasha on fire. The victim woke up and tried unsuccessfully to put out the flames, while the other passengers on the bus rushed to the victim to assist him. The bus driver said he did not immediately recognize what was going on and pulled over a short distance later. All passengers exited the bus including the suspect.
The suspect, Richard Thomas, has been charged with aggravated mayhem and felony assault resulting in serious bodily injury, according to the Alameda County District Attorney’s Office.
Thomas also faces hate-crime clauses on both counts, prosecutors said.
The suspect was in court Thursday and according to the arrest documents he set Sasha on fire “because he was homophobic.” He remains in custody at the Alameda County Juvenile Justice Center.
His family denies he’s homophobic.
“He didn’t know it was going to be like that. What kind of boy is he? He’s a good kid. He’s a very good kid. Why did he do it? I don’t know. He was joking around, that’s all,” the woman said.
Thomas’ mother, who identified herself as Ms. Jackson and spoke off-camera, saying she did not believe her son was guilty of a hate crime.
“I am very sorry for my son’s actions. I did not raise my son that way.” As for the hate crime allegations, Jackson said “No way. We have transgenders in the family, first cousins.”
In a statement today, District Attorney Nancy O’Malley called the crime senseless and said Fleischman was an “entirely innocent victim.”
“The intentional and callous nature of the crime is shocking and will not be tolerated in our community. Our thoughts remain with the victim and the victim’s family in wishing for a full recovery from the extensive burns suffered as a result of this crime,” she said.
A fund has been set up to help Sasha Fleischman with his medical bills. He’s in stable condition with 2nd and 3rd degree burns at St Francis Memorial Hospital.

Last night George Zimmerman was found not guilty in the shooting death of teenager Trayvon Martin. Protests were expected all over the United States.
San Francisco had a peaceful march through the Mission District, but leave it to Oakland to leave peaceful behind and start rioting, breaking windows and leave Downtown Oakland looking like a war zone.
Here are some pictures from last night in Oakland. They broke windows, spray painted “kill Zimmerman” and destroyed a BART cop car.

Fruitvale Station- A movie about the tragic murder of Oscar Grant on New Years in 2009 by BART officer Johannes Mehserle held a private screening last night in Oakland. Oscar Grant is shown as a man misunderstood, involved in crime trying to get his life together, but loved his family and his daughter. This incident caused outrage when the Youtube video of Oscar being shot on the Fruitvale Platform in the back not resisting police.
There were many misconceptions of this case and although some of this movie is fictionalized, will spark discussion on the underline issues still prevalent in our society today. Like the murder of Trayvon Martin, the outrage was mainly racial. Johannes Mehserle is white.
The outrage when Mehserle was only convicted of involuntary manslaughter, and not 2nd degree murder exploded into the streets of downtown Oakland with looting, fires, and Oakland PD/Alameda Co Sheriffs Deputies in riot gear. (sound familiar? Occupy protest?)
While walking the red carpet last night Mayor Jean Quan made sure that everyone knew it was a BART cop who shot Grant, not Oakland PD. Why? Because Oakland PD has been plagued with problems for many years, and recently hired Chief William Bratton to give them ideas on how they can solve some of those problems. They have been under the monitoring of a federal judge since 2003 because of past law enforcement abuses including the unnecessary drawing of guns, extortion and framing arrested individuals that is so egregious that the department may be put into receivership by the federal courts.
According to a September 11, 2011 article in the Bay Citizen, just a little over a month prior to the infamous Tuesday assault on Occupy Oakland, the federal judge overseeing the police department lambasted their conduct:
In a hearing that exposed the breadth of the problems facing Oakland, a federal judge blasted the Oakland Police Department Thursday for failing to make court-ordered changes designed to reduce police misconduct and abuse.
Before a courtroom full of city leaders and police department brass, U.S. District Court Judge Thelton Henderson highlighted a series of issues that “indicate to me the city and the department still don’t get it.”
Let’s put aside all the problems Oakland PD has had even keeping a police chief even recently going through 3 in a matter of days. Police Chief Howard Jordan announced his retirement, and the assistant police chief was supposed to interim until the city could find a permanent one, but then decided to put another long time Oakland PD officer as the interim.
Fruitvale Station is the BART platform Oscar Grant died on. Oscar wasn’t a saint. He had his problems like many kids in the bay area raised in Oakland. He seemed to be trying to get his life together when he died, and moved his family out of Oakland to a nearby city with less crime.
Johannes Mehserle, the BART cop, was convicted of involuntary manslaughter and received a 2 year sentence with time served. He remained in custody after his arrest. The trial was moved from the bay area to L.A. He was free in 72 days. The jury also added an enhancement for the gun, but the judge threw that out before sentencing.
Oscar Grant’s family got a $1.3 Million Dollar settlement from BART in 2011.

OAKLAND, Calif. —
One Goh, 44, didn’t attend his brief hearing in Alameda County Superior Court in Oakland because he’s still being treated at Napa State Hospital, where he was sent earlier this year after a judge ruled on Jan. 7 that he’s not competent to stand trial and suspended the legal proceedings against him.
Judge Jon Rolefson ordered that Goh return to court on Dec. 9 for another update on his mental competency.
